POCSO COMMITTEE
Child Protection, Safety, Awareness and Responsible Conduct Policy of IEM Public School, Salt Lake, committed to maintaining a safe, respectful and welcoming environment for every child. The School believes every learner deserves dignity, trust and protection, and works proactively to prevent abuse, misconduct and unsafe practices through awareness, vigilance and accountable action.
Preamble
As a private institution imparting public service, IEM Public School, Salt Lake is committed to conducting and governing itself with ethics, transparency and accountability. To uphold these principles, the School has developed governance structures, practices and procedures that seek to promote ethical conduct at all levels across the institution.
It is in acknowledgement of and consonance with these values that the School is dedicated to ensuring that the work and learning environment is conducive to fair, safe and harmonious relations based on mutual trust and respect between staff members, students and other employees of the School.
The School also strives to guarantee a safe and welcoming environment to all persons who visit or interact with the School in any capacity, including students, parents, teachers, employees and other members of the School community.
Discrimination and harassment of any type is strictly prohibited and will be viewed seriously. Acts of harassment, abuse or misconduct may attract appropriate action in accordance with applicable law, School rules and established procedures.
The School maintains a strong commitment against acts constituting sexual harassment or any behaviour that compromises the safety, dignity or well-being of a child or any member of the School community.
The School seeks to promote and maintain a culture in which staff members, employees, students and other members of the School community do not engage in practices that are abusive, threatening, discriminatory or inappropriate in any form or manner whatsoever.
Hence, any act of sexual harassment or related retaliation against or by any staff member, employee, student or other member of the School community is unacceptable. This policy intends to prohibit such occurrences and establishes procedures for addressing concerns within the ambit of applicable regulations.
Any deliberately false or malicious complaint or the knowing provision of false information in relation to a complaint may also be dealt with in accordance with applicable law and School disciplinary procedures.
The management of the School is committed to providing its staff, employees and students with a safe, respectful and supportive environment.
Applicability & Scope
Applicability
This policy extends to all staff members, employees and students of the School, including persons employed on a contractual or other permitted basis. The policy also extends to parents and visitors where they are subjected to or involved in conduct covered by the applicable provisions of this policy while at the premises of the School or in circumstances falling within its scope.
Scope
The scope of this policy includes conduct occurring in connection with the School and its activities, including:
- The premises of the School.
- Any mode of transport provided by the School for journeys to or from the School or other relevant locations.
- Any external location visited by staff members, employees or students due to or during the course of official School work or activities.
Definitions
For the purpose of this policy, the following terms are understood in accordance with the context of the policy and applicable law.
Sexual Harassment
Sexual harassment shall mean and include any unwelcome sexually determined behaviour, whether physical, verbal, written, non-verbal or implied, including unwelcome physical contact or advances, unwelcome oral or written communications or invitations, demand or request for sexual favours, sexually coloured remarks, showing pornography, creating a hostile environment or any other unwelcome sexually determined behaviour.
Hostile Environment
A hostile environment may include speech, conduct or written remarks that amount to marginalisation, social ostracisation, physical, psychological or emotional intimidation of the recipient or that substantially interferes with the recipient’s work, learning or participation.
Aggrieved Person
An aggrieved person means a staff member, employee, student or visitor of the School who alleges that they have been subjected to conduct covered by this policy.
Accused Person
An accused person means a staff member, employee, visitor or student of the School against whom an allegation covered by this policy has been made.
POCSO Committee
Role of the POCSO Committee
Any form of sexual abuse, sexual harassment or other conduct covered by applicable child-protection law committed against a student of the School shall be addressed through the appropriate child-protection mechanism, including the POCSO Committee and other competent authorities as required by law.
- The POCSO Committee shall consist of designated members representing the School leadership, teaching staff, counselling/support functions, non-teaching staff and senior student representatives, as determined by the School.
- Student members of the POCSO Committee shall be senior students of the School and shall participate only within the limits appropriate to their age, role and applicable safeguarding requirements.
- The POCSO Committee shall follow the procedures prescribed by the School and applicable law for dealing with complaints or concerns raised by students.
- Every reasonable effort shall be made to address complaints promptly, sensitively and appropriately.
- Where an act complained of by a School student amounts to an offence under the Protection of Children from Sexual Offences Act, 2012, the School shall take the steps required by law, including reporting to the appropriate authorities.
- The names of the members of the POCSO Committee shall be displayed through appropriate School communication channels and/or notice boards.
- The Committee may establish appropriate internal procedures and guidelines for conducting its proceedings, subject to applicable law and the authority of the School.
- The Committee may issue appropriate guidelines concerning child safety, responsible conduct and adherence to the School’s safeguarding framework.
- All proceedings concerning children shall be conducted with due sensitivity, confidentiality and regard for the dignity and best interests of the child.

Procedure for Dealing with Complaints
Complaints and concerns shall be handled with appropriate seriousness, sensitivity, confidentiality and in accordance with applicable law and School procedures.
Procedure for Filing a Complaint
- If any staff member, employee, student or visitor believes that they have been subjected to conduct covered by this policy, they may approach an appropriate member of the Committee, School leadership, counsellor or designated School authority.
- A Committee member receiving a complaint shall promptly communicate the matter to the head or designated authority of the Committee and take appropriate steps under the applicable procedure.
- Complaints should ordinarily be made as soon as reasonably possible after the incident so that the matter can be addressed effectively.
- There shall be no unnecessarily restrictive format for making a complaint. The complainant should, wherever possible, provide a clear and detailed account of the incident together with relevant supporting documents and the names of witnesses, if applicable.
- Where additional information or facts become available, the Committee may consider them subject to the applicable procedure and circumstances of the matter.
- Anonymous complaints may also be brought to the attention of the School. Such complaints may be considered by the appropriate authority and acted upon to the extent reasonably possible, subject to the requirements of applicable law.
- Where an aggrieved person is unable to make a complaint because of physical or mental incapacity or other legally recognised circumstances, the complaint may be made by a person authorised or permitted under applicable law.
- Where a complaint clearly falls outside the scope of the policy or does not disclose conduct requiring action under the applicable framework, the Committee may determine the appropriate course of action.
Process of Enquiry
- Once a complaint has been received and considered, the appropriate procedure shall be initiated in accordance with applicable law, School policy and principles of natural justice.
- Where appropriate, the substance of the complaint and relevant documents may be provided to the person against whom the complaint has been made, subject to safeguarding, privacy and legal requirements.
- The person against whom the complaint has been made shall be given a reasonable opportunity to provide a response or explanation in accordance with the applicable procedure.
- The Committee may conduct meetings or hearings with the concerned persons and review relevant documents, records and other evidence.
- All hearings, documents, statements and evidence relating to a complaint shall be handled with appropriate confidentiality.
- Parties who are unable to attend a scheduled meeting should provide reasonable advance notice wherever practicable.
- Every reasonable endeavour shall be made to complete the proceedings within an appropriate and reasonable period.
- The Committee may take statements from the complainant, the person against whom the complaint is made and relevant witnesses.
- Appropriate care shall be taken to prevent retaliation, intimidation, threats or victimisation of complainants and witnesses.
- During the enquiry, all concerned persons shall refrain from threatening, intimidating, influencing or otherwise interfering with witnesses or the enquiry process.
- Proceedings shall be conducted fairly and in accordance with the principles of natural justice and applicable law.
- The Committee shall carefully consider the circumstances, evidence and relevant statements before reaching its conclusion.
- The Committee may recommend appropriate interim protective measures wherever necessary to safeguard a child, complainant, witness or member of the School community.
Decision
- Once the enquiry or investigation has been completed and the relevant submissions have been considered, an appropriate determination shall be made regarding the allegations.
- Committee members shall consider the available information fairly and objectively. Where a voting mechanism is applicable under the governing rules, each member shall have the voting rights prescribed by those rules.
- Where misconduct or harassment is established, appropriate remedial or disciplinary action may be taken in accordance with the applicable School rules and law.
- Such action may include appropriate disciplinary, administrative, protective or corrective measures depending upon the circumstances.
- Any action concerning a child shall place appropriate emphasis on the child’s safety, dignity, privacy and best interests.
- The outcome shall be communicated to the concerned parties to the extent permitted by applicable law and confidentiality requirements.
- Deliberately malicious or knowingly false complaints may be dealt with under applicable disciplinary procedures, provided that a complaint shall not be treated as malicious merely because it is not substantiated.
Where a complaint or information indicates that a child may have been subjected to an offence under applicable child-protection law, including the Protection of Children from Sexual Offences Act, 2012 (POCSO Act), the School shall take the actions required by law and shall not restrict or delay statutory reporting obligations through an internal enquiry. The safety and best interests of the child shall remain paramount.

Every student should be treated with dignity, respect and fairness.
Awareness
Students should receive suitable awareness regarding safety, boundaries and responsible conduct.
Trust
Students should be encouraged to approach trusted adults when they need assistance.
Confidentiality
Complaints and sensitive information should be handled responsibly and confidentially.
Prevention
The School promotes preventive measures and responsible behaviour.
Accountability
Conduct inconsistent with School policy or law may attract appropriate action.
Zero Tolerance
Abuse, exploitation, harassment and conduct that endangers children will not be condoned.
Miscellaneous Provisions
- The names of the members of the POCSO Committee and other applicable School committees shall be displayed on the School notice board or through appropriate official communication channels.
- Appropriate complaint mechanisms or complaint boxes may be maintained for students and other members of the School community, with clear identification of the mechanism to which a complaint is intended to be submitted.
- Complaints concerning children shall be dealt with in accordance with applicable child-protection requirements and statutory reporting obligations.
- Where applicable, the School shall maintain appropriate records and reports concerning complaints and their disposal in accordance with the requirements of law and competent authorities.
- The School shall cooperate with competent authorities and statutory agencies wherever such cooperation is required by law.
- The School reserves the right to amend, modify, revise, replace or reinstate this policy or any part thereof, subject to applicable law and regulatory requirements.
- Any amendment to the policy shall be communicated through appropriate School channels.
